Child Custoday Question

Under what circumstances can a relative be awarded custody of children (namely, niece and nephew) from a widowed parent? The widowed parent is the father, the mother was the sister of the person wanting custody.

As you are the child's aunt and not the child's parent you would have to establish the child's parent was unfit are incapable of caring or providing for the child.
