Legal Question in Family Law in Georgia
Child custody given to family members
My nephew began living with me when he was 4 years old. There had been issues with his parents and their ability to take care of him and show him the love he needed. His mother kidnapped him from California in 2006 and moved to NJ with her new husband. Only to come forward a year later and admit that she didnt want him. She called the adoption agency and everything and was going to put him up for adoption without notifying my side of the family. Long story short, my husband and I drove to NJ last june to pick him up and he has been with us ever since. His mother didnt call on his bithday or christmas or anything. She has told me several times that she didnt love him, and didnt want him. Early this morning I get a knock on my door from the police (almost a year later) and she wants him back. Because she is his biological mother they gave him to her, regardless of her previous child abuse/neglect charges and the adoption issue. I want him back. My brother is willing to sign over his parental rights to me and my husband so that we can raise him. I need some serious help. I need to know if I have any rights, and if so what they are. I am scared for his life while living with her. She is on depression meds and may do anything to him
