Child custody & Father's rights

My brother has a 5 daughter. He & the mother have never been married. He initiated the legitimization & child support process back when his daughter was a few months old. As far as his visitation, he got the minimum of every other weekend, every other holiday & 2 weeks in the summer. For the past 5 years he & the mother have been in an on again/off again relationship. WHen they are 'on' she allows him extra time that has not been wirtten up in the papers, when they are ''off'' she quickly takes away this extra time & reverts back to the papers. He is a good father & we are a good family that just adores the little girl. Is there anyway to change how much visitation he gets? Furthermore, can he try to gets custody based on the fact the the mother is unstable & uses the daughter when she doesn't get her way? WHat are the chances in Georgia of that actually happening?

No one could give you "odds." However, if he displays good parenting skills and a stable lifestyle, and there is a history of him spending a lot of time with the child, there certainly is a possibility of expanded visitation or even a custody change. This is something he needs to explore with a lawyer.
