Legal Question in Family Law in Georgia
Child Custody in Georgia
I have a near 3 year old stepson. His Mother and I have been married for over a year now. My stepsons father has been threatening fighting for some custodial/visitation rights. My question is: what is the chances he actually gets some sort of custodial/visitation rights based on these facts.
1) The child was born out of wedlock
2) The father of my stepson hit my stepson when he was 11months of age and recieved a petty $250 fine and 1 year of probation.
3) The father has recently been visiting his son on mother supervised approval but fails to show up no less than 30 minutes late.
4) The only form of child support he has given amounts to about $200 for the year 2007. $40 money orders. Pays when he feels like.
5) Due to nightmares/terrors my stepsons pediatrician has recommended that my stepson does not see his biological father.
If anyone can help that would be great! Thank you!

I would suggest that you do call around to attorneys in your area and find out how much something like this will cost. And if you do nothing else at least have an attorney in mind and money saved so if he does do something you are prepared.

Stop worrying about a non-existant case. If a case gets filed, see a lawyer and worry about it then. But there's no case, so you have nothing whatsoever to consider. A person who actually is going to file something would be meeting with a lawyer, not warning you. You do not have a legal problem at this time.
