child custody
my grandson's parents have never been married. he is now 9 and has lived with our son - his dad- since he was 3 and his mother left. my son has never gotten signed legal custody. the mother is now in jail. should my son get her to sign over custody? what would happen to my grandson if my son became ill or died?

Your son has no legal right to custody without a court order. A mere piece of paper won't change that. The mother, even while in jail, is the legal custodian. It is vital that your son get a lawyer right away to legitimize the child and obtain custody. If the mother will consent and sign the cost will be far less than otherwise.
