child custody

i live in georgia my ex-husband lives in michigan we have 2 minor children. I have full custody. summer 2007 while the children were in Michigan he took them to a psychiatrist without my knowledge. I only found out because I was sent a bill by mistake. I have refused to send the children back with him now he is seeking custody. Is this a good reason for his custody rights to be denied? Can he or the doctor be sued for taking the children to a psychiatrist without my authorization
