Legal Question in Family Law in Georgia

child custody modification

I got my final divorce decree in Oct 1998, I was awarded custody of three minor children without contest. Then the kids decided to move in with their father and I agreed, he had child custody modified to this and child support stopped, this was Nov 1999, Now my 15 year old son has moved back. Do i have to have a lawyer to modify the custody again. Also the father let him move back home, but refuses to pay any child support. What procedure do I use to handle this situation

Sincerely,

Re: child custody modification

One: no, you don't HAVE to have an attorney. But do you know the legal steps to follow? Two: Your procedure would be a modification to try to reinstate child support. However, you might not get far since once you agreed the father could have custody he is legally allowed to use the "non" child support that he is not paying to maintain a home for the kid in case the kid wants to come back to dad.
