child custody

I have a 9 month old son. I am not married to his dad, although his name is on the birth certificate. Is it illegal for me to take my son out of state without his consent?

The child is illegitimate. The father has no access rights to the child. Yes, you can do whatever you want with your son. However, he cannot.

Unless he legitimated the child in court and has a court order saying no, you can go anywhere you want.
