child custody for unmarried parents

I am planning to move out of the country with our two minor children since my stay here is over. Their father is aware and agrees to it. They will visit each other on a regular basis. We were never married but his name does appear on their birth certificates. I would like to know which forms I should use and where to get them to file a petition allowing me to be their primary caregiver or legal custodian so I am able to make decisions in their lives without having to get his permission since I will be overseas. The county courthouse was not very helpful to me and just told me to get the paperwork and take it to them but would not tell me what paperwork or where to get them. I would appreciate any help.
