Child Custody

My wife and I divorced three years ago. Our youngest child was born six months prior to our divorce. In the divorce settlement we agreed to joint custody. She has since remarried. However, she and her current husband are divorcing. My ex wife and her present husband had an affair during my marriage to my ex wife. Therefore, while I am fairly certain that our son is my naturally born son, her soon to be ex husband is saying that the child is his and he will be suing her for custody.

My question is that if the child is his biological son, does he have any rights to custody given that all legal documents name me as his father?

He'd have to sue you as well, and the ultimate answer would likely hinge on paternity tests.
