Legal Question in Family Law in Georgia
Child custody
I am 20 Years old and I have 2 children. The problem i am having is with my first she is 2 years old and currently not living with me, though i never gave up custody she is living with my Grandmother. She offered to take my daughter until i could get my life on track, i was not living the best life. I have cleaned up had another child and i am now married my husband is serving in the U.S Army and we have our life back on track but now my grandmother will not give me my daughter now because she does not like my husband and she thinks we will do wrong by the child, she wants us to prove ourselves. What can we do? since i never gave up custody can i just take my daughter and what can the father do in this case since they are in florida and we are stationed in Georgia? If we must go to court for this will i have a chance of getting full custody although i have missed so much in my Daughters life?

Re: Child custody
If you have not had your parental rights terminated you have every right to peaceably retrieve your child from your grandmother. As long as you keep it peaceable you do not need an attorney or court order. But the key word is peaceable. If you cannot do it with out violence then work through the court in Florida. Get a judge's order and have the sheriff help you remove your child. Your husband may be able to have an Army JAG officer help him with getting this done.
