Legal Question in Family Law in Georgia

Child Support after age of 18 & not in public school

My husband has to continue to pay child support for an 18 year old who dropped out of public school 2 years ago after failing 6th grade for missing 55+ days of school, being promoted out of the 8th grade after missing 70+ days of school because the middle school wanted rid of him. Had heart surgery 2 years ago, is perfectly fine after surgery, was homeschooled by the school system the remainder of that year. In March 2004 he enrolled in American School (correspondence high school)NOT computer based. He should've finished 6 courses by now & has barely completed 2. Ga. says school is certified to their satisfaction. He has 4 years to complete, will be lucky to complete in 4 years at this rate & we'll have to pay child support until he's 20 yrs old! while he plays with ''home school''. His mother never even earned a GED & obviously can not home school him, he just gets assignments, & mails it back (or could have someone else do it for him, etc). This flies in the face of what child support & child support enforcement is meant for. As an aside: My husband was never late on child support until his ex was granted 37% of his military retirement late last year (which was never in final decree) she gets $ for nothing! HELP!

All parties must comply with the divorce decree unless and until it is changed. You should consult with a local attorney about a Petition to Modify the decree.
