Legal Question in Family Law in Georgia
Child Support and Custody Issues
My husband and I separated in 6 months ago. We have 2 children and are both residence of GA and had a verbal agreement on child support and custody. That agreement was $600/ month, which he has not paid and weekend visitations, which he keeps if his schedule permits. He has inquired to keep the kids for an entire month, limiting me to just visiting them at his residence. I offered another solution, allowing them to remain in their summer camp and he can pick them up Thurs. evening and keep them for the weekend. That solution was not acceptable. After objecting he threatened to pick the kids up next weekend and ''hold them'' for a month. Can he do this?

Re: Child Support and Custody Issues
Sure. Until there is a court order in place, everyone can pretty much do whatever they want. Until a court rules otherwise, he has the same rights to the children that you do. You are long overdue to see a lawyer, as only a divorce case will resolve these type disputes and your position will likely be weaker once he has the children.

If you and your husband are uncertain as to whether you are going to attempt reconcilliation, then you should seek a formal separation in the courts. By doing so, everyone will have rules of conduct, which may make reconcilliation more likely. If you are certain that you want a divorce, then you also need to go through the courts. Either way, you should seek legal representation without delay.
