how is child support determined and what is the % normally?
This question is for my son who has a court date for his infant daughter. The fact that his ex-girlfriend stopped taking her birth control pills and never told him I do not know if this is pertinant. the paternity tests have been done and he is waiting for his court date. His annual income is about 12,000

Child support is determined by the number of children involved and a percentage of gross pay. So if there is one child involved, the child support will be between 17 and 23% of his gross pay.
Fault is not divided. If the paternity test shows that he is the child's father, then he will be responsible for that child.

First a comment: Your son needs to become more responsible. You do not have sex with anyone unless you are willing and able to support a child. All birth control can fail (and people also may not be truthful) so if he isn't using a condom he is taking unacceptable risks.
If it is his child, he owes child support, and may also be responsible for health care and birth expenses. Support will usually be set at from 17-23% of his gross income. It is irrelevant who did or did not use birth control.
