Child Support

I divorced in '91. I have 2 children which I pay $110/wk for each child. My divorce papers state that my child support stops when my child(ren) become 18 yrs. of age, self-supporting or gets married. My daughter is 20 yrs. of age and I cannot get my company to stop taking child support. They say I need a legal document. I cannot find out why I cannot get this child support for my daughter stopped or what legal document I need. I consulted an attorney and her comment was ''you should be lucky that that is all you pay. If you go to court, she will ask for more and you will have to pay more''. I make approx. $70,000 per year working 6 or 7 days every week of the year except vacation weeks. I cannot exist on 40 hours per week. My daughter is in college and I bought her a car, pay the payments, insurance, help with college tuition, buy books and pay part of her rent. What do I need to do to stop paying $110 per week to my ex? Thank you if you can answer this.

I take it your company has been deducting child support from your pay. The other attorney may be right that if you take your ex back to court she may ask for more. However, it doesn't appear that your ex has done anything wrong. I would show your company a certified copy of your divorce. If they still refuse to stop the deductions, I would consider taking the company to small claims court (if the total deducted since your daughter turned 18 is under the cap for small claims court in your county). That way you would get the company in front of a judge who could explain the error of their ways. Your ex may not even know about it.
