Legal Question in Family Law in Georgia

Child support

Do you have to be divorced from the children's father in order to receive child support? We currently do not live together and he does not provide any support. Can I take him to court just on child support issues?

Re: Child support

You can pursue support and should do so without delay to prevent him from getting too behind. Although there is no guarantee that a judge will award attorney fees to you, you will be able to seek them as part of your action.

Yes, you can do child support without a divorce. Once he goes 30 days without paying, he can be jailed even where there is no support order.
