Child support

My husband just received a summons to appear in court for child support filed by his ex-girlfriend. One of the documents they requested for was his tax returns for the past three years. Two of them we filed joint, one was separate (we were separated last year). He averages about $20k - $25k annually and I average about $85k-$100k annually. Will the court consider my income in calculating child support. I have 5 kids (4 from prevous marriage) and I worked hard to give them the a descent lifestyle, even as a single parent. I should not have to be punished for working for my children and hope the court does not take away from me and my children just because his ex-girlfriend chose to not work. She has had gov't assistance and is now pregnant with her 4th child by a 4th boyfriend, all different fathers.

No, your income will not appear in the calculations but might be evidence of his overall financial condition. His income will the income entered into the worksheet and will be the one used to calculate support. Your question does not indicate whether this child is legitimate or not or whether this is a paternity suit or one for just child support. I would suggest, if your husband wants to be a part of this child's life, that he file a petition to legitimate the child and get some access rights to the child, maybe even joint custody.
