Child support increase

When a father is taking to court for a child support increase does the judge take into consideration that he is remarried and now has 2 more children?If so what is the normal percentage that he would be required to pay?

You didn't give me the vital fact of how many children he has from the first marriage and whether the children from this marriage are legally his or his wifes. This is vital to the answer.

As far as percentages go the Court takes a boat load of factors into consideration. All things being equal though, you can estimate about 20% for 1 child, 25% for 2, and about 28% for 3 or more. The Code gives specific ranges, but this estimate should give you an idea. If the children are your Dad's,then the answer is yes, the Court will consider it. But don't expect them to waive or reduce greatly his amount of support. The Court will also consider the fact that he has a Wife who can work and support their current children.
