Legal Question in Family Law in Georgia

child support increase

My x-wife said she is going through the Child Support Recovery to file for an increase in child support for our one daughter. I am self employed and needed to know what the state would look at as far as income on my tax return. Can they add back any deprecciation, etc.... Also, can the percent of support change from the orginal decree without going back to court? Please advise, so when I get the papers to respond, should I have an attorney to do this for me or on my on?

Re: child support increase

Child support recovery can seek court orders and it does take one order to replace another.

Since it is very possible to manipulate income for tax purposes but have money that isn't taxed, computation of self-employment income is complex. Yes they could add back in items like depreciation.

In any legal matter it is wise to consult with a lawyer before doing anything. Until and unless you receive papers, you have nothing to consult about. At that time, you do.
