Who has child support jurisdiction?

Situation:

Custodial parent: California

Non-Custodial parent: Georgia

1 Child: 2 year old boy (lives with custodial parent in California)

Parents never married

No current child support order in place; however, paternity positively established

Neither custodial parent nor child ever lived in Georgia. Last place of residence for custodial parent and child prior to California was Kansas (child born in Idaho).

I (custodial parent) am wondering if I can file in California for child support orders? I have lived here 2 months now and am employed. Does Georgia (where the non-custodial parent resides) have the right to order child support on Georgia guidelines or can California order child support under California guidelines?

The local Child Support Agency can contact the state of Georgia and obtain a court order for child support. Normally child support is based on the child support laws in the state where the order is made.

It is unlikely that father has had sufficient contacts with the state of California for it to have personal jurisdiction over him.
