Legal Question in Family Law in Georgia

Child Support...

I am about to become a legal adult and I was wondering if I would win if I sued my father for not paying about 9+ years worth of child support, after I turned 18. A court ordered him to pay a set amount every month, he payed for a few months, stopped for a year, pay a couple more. He lives about 2 or 3 states away and is most likely evading payment of child support.

I live on about $7,000 a year along with my mother. I would just like to get the restitution I deserve.

According to TITLE 18 PART I CHAPTER 11A 228 of the US Code collection... I would at least have him sent to prison for up to 2 years and be paid restitution by the court. That would be satisfactory...

Thank you for any advice in advance...

Re: Child Support...

Before taking action that will send him to jail (thereby cutting off his ability to pay, at least for the two years), you should consult with a local attorney about a contempt action with your mother as the actual party, since the child support was awarded to her. This would be filed in the county where your parents' divorce was filed. You have a good chance of winning.
