Legal Question in Family Law in Georgia

Child Support Modification

I have 7 kids. One step-son I'm in the process of adopting, a set of twins that I pay support for in another state, two children in GA from my previous marriage, and two daughters that I have with my current wife. When I had my support modified in PA, my wife's income wasn't considered. When the support for my children from my previous marriage was established no other children were considered other than the two from that marriage. I'm now in the process of modifying the support to reflect all of my responsibilities, 5 other children and I've provided all of the documentation and now my ex-wife and her attorney are demanding to know my wife's income. I alone pay child support, by law do we have to submit my wife's income? It's unfair to her, not to mention I already do not contribute to our household because of all of my other obligations. Please help.

Re: Child Support Modification

They are entitled to know your wife's income. It is not so that your wife can pay your child support for you. When the child support obligation is calculated, the approach is to first calculate the amount of your child support obligation to the children who live with you. A computer program is used and your income and your wife's income are entered to calculate your child support obligation to the children in your household and the amount that obligation to your household children is used, as a credit, to calculate your child support obligation for the children outside of your household.

Re: Child Support Modification

As I am sure your lawyer has told you, information about your household's income is a very normal routine request.

Re: Child Support Modification

It depends on what state you are filing in. You have mentioned three separate states. Consult with a local attorney. My guess is that that info must be produced in any state.
