Legal Question in Family Law in Georgia
Child Support Modification - Non-custodial out of state transfer
My husband was transferred to Texas from Georgia. He is now in the process of fighting for visitation in Texas. The opposing side is arguing he did not have to move, so he should be responsible for travel expenses. Georgia Law will take into consideration extensive travel for visitation in caculating child support. Background on his transfer - at the time of his transfer my husband was making less than $20,000.00 a year and paying $500.00 a month in child support. This transfer would give him a substantial raise ($12,000.00 a year). He now is paying $725.00 a month in child support.
My question is are there any cases that can be sited
under the same circumstances.

If you are asking if there are any cases, in which travel expenses are a factor in determining child support, I'm sure Texas and Georgia each have a dozen which are known to your attorney. (I presume you have an attorney). Depending upon the trip and the visitation, the Court will probably not reduce child support significantly because it is not a great expense from most places in GA to most places in TX.
