Legal Question in Family Law in Georgia

Child support requirements from state to state

My fiance was divorced in GA. in 2000. In the court order, her ex was ordered by the judge to pay either 65.00 per week in child support OR 20% of his gross income, whichever greater. He has since moved to Oregon, causing a problem in the enforcement (has paid 12 months out of 5.5 years). Over the past 1.5 years, she has gone through a hard time getting ANYTHING....now she receives about 280-300 per month (dep. upon 4 or 5 weeks in the month)...Now the Oregon enforcement will not recognize the court order of 20% of income (he makes well over 1000.00 per month now). What can be done? Please, if possible send any answers to my email [email protected]..

Re: Child support requirements from state to state

You need to modify this order. In my experience, self modifying orders are difficult to enforce and are not given a lot of weight in the court. Unfortunately, modification will need to be in Oregon, since taqht is now the state of his residence.
