Legal Question in Family Law in Georgia

child support

I am a single mother of triplet boys, they are 14 months old. When i left there father child support enforcement went after him.They finally found him and he pays 540 dollars a month for three babies, They only ordered him to pay 26 percent of his income.I have been reading and I found out they could have taken 33 percent.over the last 2 months I have only recieved 2 checks a month he is way behind when i called there office today they said they cant do any thing until he is 30 days behind.So now he says he is only going to send one check a month because he knows nothing will happen.I just need to know if i would be better off getting a lawyer and taking him to court.I dont have money for a lawyer but i dont think this is fair. Thank you

This is a general answer as we don't have all the detailed facts, and those might affect the answer.

In Georgia the child suport guidelines for 3 children range from 25-32% so the amount is within that range and it would be difficult to modify for that reason.

While they could pursue him sooner, in general they won't pursue a person less than 30 days in arrears. Since the costs of pursuing that small a sum yourself would exceed the amount you'd pursue, it probably doesn't make a lot of sense for you to take the case over. You could but you might spend a dollar trying to make a nickle.
