Child visitation

My brother's girlfriend took his little boy and left the state to move in with her mother while my brother was at work. She is telling him that he cannot see his son until he files seperation paperwork....they are not married so why would he need to file seperation paperwork?? But what kind of paperwork does he need to have drawn up to be able to visit his son?? Can she do this?? And he is sending her money for the baby.

If they are not married, he has no rights unless he legitimates the child and seeks either custody or visitation. He needs a lawyer.
