Legal Question in Family Law in Georgia

Child's Right to Choose

I would like to know, according to the laws in the state of Georgia, what age is a child able to decide whether or not they want to go on the designated visitations? I understand that at the age of 14 they can choose where they want to live, but what about whether or not they want to visit the non-custodial parent and if they can choose the length of the visit?

Re: Child's Right to Choose

That's a hard question to answer because it usually depends on circumstances. The custodial parent is always required to make the child available during scheduled visitation and to encourage the child to visit with the other parent. However, the older a child is, the courts seem less willing to force the child to go.
