Legal Question in Family Law in Georgia

My child's father and I share joint custody of my daughter, however I am the legal physical custodial parent. He was ordered to pay child support as well as provide health insurance until she 18 years of age. I have not seen or spoken to him in over two years, he does not follow our parenting plan and has since moved out of state. He pays child support through the state but has not provided insurance in 3 years. Am I able to file for full custody of my child without going back through the court system?

Custody requires a court case, and a judge. It may possibly not make sense to seek what you pretty much already have in practice, but sit down with a lawyer to discuss it. A new case also opens the door to modification of support and other issues. You may be better served with a contempt case over the insurance. - Glen Ashman 404-768-3509
