Legal Question in Family Law in Georgia

Can the childs mother take him from me?

3 years ago my sons girlfriend brought their 19 month old son to me and left him but never came back for him. I went to court and got custody (she signed him over to me). She hardly ever comes around and she has never paid any child support. The state of Alabama is looking for her for child support now. He lives with me and his natural father. I got on to her for calling and saying she was coming to see him and never showing up, it upsets the child and it hurts him, so now she's mad with me and said she's gonna come get him...can she do that? There are records where child-welfare was about to take him,but me and his Daddy got him instead. Will it be that easy for her to take him? Thank you foor any help you may offer. She lives in Georgia.

Re: Can the childs mother take him from me?

Need to know what State the child is in. Also, you didn't say whether you had temporary custody, permanent custody, or a guardianship. All of these factors play into the mix. This is not a simple legal question that may be answered here. You should strive to get permanent legal custody so you don't have to worry about her anymore. Also, what is your relationship to the child? Are you a family member? Is your situation stable and appropriate for the child? There's a lot of information missing that can determine which way a custody case may go.
