claim child on taxes

I am the father of a 5 year old and have been paying child support for over 5 years. Never married to the mother who is on welfare. I claimed my daughter in 2005 and have received a letter stating that she had been claimed on another person's taxes. Is this legal if the mother does not claim to work, receives assistance, medical card for mother and child and is on section 8 housing. I have not seen my daughter for over a year due to the mother not following the court order.

You can't claim a child who is in the mother's legal custody unless you have a written consent on the appropriate form from the mother. Go see a good CPA to see what you now need to do. You appear have a tax problem and you probably owe penalties for this.
