Legal Question in Family Law in Georgia

Cohabitation Laws

I lived with my boyfriend for 4 years, just recently moved into his house for 30 days. I want to go get my furniture and remaining clothes, he has probably already changed the locks. He also have some of my furniture in storage, in his name. What are my legal rights and how can I go about getting my furniture and clothing items back.

Re: Cohabitation Laws

Cohabitation has nothing to do with it. GA does not recognize common law marriages. What is your stuff is your stuff. Call the cops and ask that they escort you while you get your stuff. Also, consult with a local attorney.

Re: Cohabitation Laws

You have very few rights when you cohabitate illegally without marriage (especially if you do it without having a lawyer draw up a written agreement). An old Georgia case pretty much limits your remedies. If he will not give you your things, you might try suing him for the value of those items in Magistrates Court (Small Claims Court).

Re: Cohabitation Laws

The obvious first step is to act like two adults and work it out. You don't mention making that attempt. Involving lawyers and police without trying that first would likely only lead to more negative action by one or both parties.
