common law in ga?

me and my girlfriend live together for nine months and we started to have problems so for the last three months we live as room mates, I got sick of this so I broke up with her and I gave her a 30 day notice in writing because we were renting a apartment together, I had to move from GA to NC so I had to make a few trips but as I made the frist trip, when I got back I found that she had a in house yard sale and sold over $24,000 of my stuff. I am taking her to court but some people say that because of common law that I won't win. what are my chances.

Georgia no longer recognizes common-law marriage. An old case, Rehak v Mathis, generally prevents the courts from assisting either party in a live-in relationship at all, so you possibly would see your case dismissed because of that precedent, unless there are facts undisclosed in your post.

GA no longer recognizes common law marriages, so that puts you guys in the position of having been just roommates/lovers. Due the amount involved, I would recommend that you consult with a local attorney for advice about how local judges are handling these cases.
