common law marriage

if a couple was together in 1991 split up in 1995 but remained in the home for the children with a verbal agreement from the beginning there was no marriage ever are they common law married

You do not need to pay a lawyer to point out the fact that according to your post, neither of you wanted a marriage. You also don't need to pay a lawyer to tell you that the law does not force a marriage on 2 people who never wanted to be married. Common law marriage - which has not even existed in GA in many years, but did in the early 90's - required some intent to be married.
