Common-Law Marriage

I lived with a man for 2 and 1/2 years, I was listed on his insurance policy as his wife, between the years of 1995-1998. We were considered common-law married. Do we need to get a divorce before we marry someone else?

You make the assumption that you were considered husband and wife and you may well be correct. However, it would depend on all the circumstances. The test is whether you held yourselves out to the whole world as such, coupled with the intention to be married. If all of this is present, then, yes, you need to get a divorce.
