Is it considered legal abandonment if the father of your child was arrested during your pregnancy, and has been in jail for the past 2 years? He has only seen my son twice in jail..

I'm not sure what you're asking as there is no such thing as "legal abandonment."

There is a criminal abandonment statute which punishes those who go for 30 days without payinmg child support.
