Legal Question in Family Law in Georgia
Contempt
My ex-husband is supposed to pay half of any costs that my insurance does not pay for and keep dental insurance on our daughter. She now has braces, which is not covered by the insurance that we have and he has never provided her with policy information. It is over $220.00 a month that I just don't have. I have sent him one letter and a letter to his father with a copy of the divorce agreement, so he can't whine that I am being unreasonable. My question is what steps can I take to file contempt charges against him? P.S. I had to write several letters to the judge that granted my divorce to get him to pay child support. It will get very ugly and I just don't have the extra money to pay for an attorney. I would appreciate any information.

Re: Contempt
You would need to file a motion with the court in which the final decree was issues. In some circumstances you can file that in the Superior Court in the county which your ex-husband lives. He would need to be served with that motion by a sheriff just like starting a new case. I would suggest getting a court date when you file your motion.
I don't doubt your ability or tenacity, but you may want to get a lawyer involved. Some lawyers will do this sort of case without money up front since it is likely that the court would order your ex-husband to pay your attorney's fees.
