Contempt/motion to set aside

The above has been filed and the Defendant has affirmed that he did one of the items stated in the Contempt/MTSA. My attorney wants to now file an amended Contempt/MTSA awith an added ''Mutual Errors'' statement. This based on both attorneys not including in the final Settlement Agreement information verbally agreed upon. My questions are: 1) If we filed the amended Contempt/MTSA, then can he plead that he does not have to pay my attorney fees due to their having made the error? Any case siting for this?

2) The Defendant in the case was supposed to refinance the martial home into his name. Instead he forged his wife's name on checks, tircked his wife into accompanying him to the bank and paid off the martial home instead of refinancing the home. Any legal cases or thoughts on how to present this in court? Any case law to refer me to?
