Correct FORM for non-wedded child custody/support
My fiancee had two children by her ex-common law husband. After separating (7yrs ago), they both signed an agreement of joint custody (hand written). The agreement calls for 6months each, and no support. The father has not kept up his end of the 6months (only some weekends) and refuses to pay child support. She wants to use the ''Change of Custody and Child Support'' form off of the Fulton County site to represent herself. Will this form work in her situation?

There are various issues involved that would likely need the guidance and/or assistance of legal counsel. Although the form is very thorough it may not be tailored made to fit the particular situtation. What needs to be done in this matter is a change of custody and a determination of child support rather than a change of child support because there is not yet an established child support obligation.
