Legal Question in Family Law in Georgia
Does it count?
1-04-2005
Hello: I filed for child support for my daughter in Oct. 2002. I was awarded $376 per month in 2003 this was based upon his working income.
I recently found out that he received a settlement in 2002 in the approximate amount of $80,000 from a work injury.
This income was not reported to the child support agency when they were considering how much he made that year. Is there a possible back pay that could be owed to me since it is considered income?

Re: Does it count?
You would need to move to have the support decree modified to reflect the change in economic circumstance. The settlement would probably be included if it was for lost income. If it is a workers' comp claim, it would be included because a lump settlement of a workers' compensation claim is primarily for future lost wages.
