4 months ago CPS came to my home and drug tested me, I failed. CPS dissapeared. 2 weeks ago I left my 3 children with my friend, who is the only person who has ever watched my kids for me,I went to the laundromat. I was gone for 4 hours. When I returned my friend told me that my father in law had come to her home and had taken my kids saying that CPS told him to, and that if she did not let them go they would come back w\warrants. When I got home, my kids had been put in the State's custody. We went for the probable cause hearing, The ONLY thing (besides the drug test 4 months prior)that anyone could say about my childrens well being was that my 11 year old son was sad about his dad being in jail. I believe the reason they came back was because of my husbands arrest, even though I have NEVER been arrested, the police has NEVER been to my home I dont have any criminal charges whatsoever. My children are happy, healthy wonderful children. CPS said that they acted on an anon. tip. An anonomous call is never considered ''probable cause'' under the law. My in-laws are suspected of being the callers. They have my kids now and have filed for custody. My father in law is trying to get my 1 yr. old to start calling them ''mom & dad'' please h

You need a lawyer now. If you don't have enough money, ask the Court to appoint a lawyer to represent you for free. Go to the Pretrial Services office in the Court house to make this demand.
Call my office on Monday to discuss this -- we're in the same town. Make sure to tell them you found my name on the LawGuru web site so I'll know who called when I return from court. Even better, ask the staff to make an appointment for you and come in to see me. No charge unless you decide to hire me after our meeting.
