Legal Question in Family Law in Georgia

What if custodial parent marries an inmate?

My ex-wife has sole physical custody of our six year old daughter, and I have visitation. We both share joint legal custody. My ex-wife is currently engaged to an inmate (robbery conviction), and through her efforts, there is a good chance he'll get parole in 2007. Would my ex-wife's marriage to an inmate result in her being classified as an unfit parent? Would I have any chance at getting sole physical custody? (I have been married for 1 1/2 yrs, I have a good job, and my wife is a stay at home mom. We have three children total-my daughter, my wife's daughter, and she and I have a son together.)

Marrying an ex-con does not in and of itself make your wife an unfit parent. However, you should consult with a local attorney about an investigation as whether other factors my help you, e.g., drug and/or alcohol abuse, other bad contact, etc.
