Legal Question in Family Law in Georgia

Custodial Parent Moves Out of State

Two questions:

1. My ex-wife has recently suggested that she may move herself and our 2 children out of Georgia. How does this impact child support, visitation, etc.?

2. My ex-wife and I had an uncontested divorce. Though I did not want the divorce, resisting would have been expensive and eventually had the same resolve. Our agreement, among other things, stipulates child support payments that fall within the GA guidelines. My income will likely soon rise to a point where she will no longer have to work. I don't think that this is the intention of child support. What are my options?

Re: Custodial Parent Moves Out of State

First, unless the decree states how visitation will be handled if one party moves, it will stay the same and you will have to go back to court to change the setup. Child support will not change. Second, child support is set up by your gross income, so you dont have much of an option there unless her income is substantially greater than yours.
