custodial parents rights when ex has guardianship
I am the legal custodial parent to my two children with my ex having joint custody. I had enlisted in the Army and they made me give my ex husband legal guardianship over my two children. They went to live with their father. I ended up not going into the military and now my ex husband is trying to keep my children from me. I want to know what my rights are being custodial parent and if I can go get my children from him legally and have them live with me.

Your rights should be set out in the custody decree. You may request a modification of the custody decree due to a change in circumstances, but ultimately it will be up to the court to decide any custody issues.

You should contact a local attorney who can review your divorce documents. Depending on the wording, you may or may not be entitled to any relief.
