i have custodial rights of my9 yr son and he has we and his dad for summer visit and his dad will not return him , his dad says he has filed for custody , can he do this

No one here can answer because you failed to say what your paperwork says, or tell us what the paperwork he filed says. Call the lawyer who handled the original custody case for you to either cite him for contempt pr kidnapping if he is in the wrong, or to defend you in the suit he filed.
