My husband and his ex- wife has 2 children together, which he has legal custody of. The ex has another child by another man. The child has been living with the ex's father for 5 years. the ex has legal custody of the child, At one point in May of 2000, she allowed the grand father to have temporary custody of the child at a hearing, The order expired in May 2001, there have been no more hearings since,

The child wants to live with me and my husband and her two half sisters, the ex has no problem with it and has even put something in writing saying so. My question is, can the grand father do anything legally to make this not happen? After the order expired, the custody went back to the ex. If it helps, the biological father has never been in the picture, and is not listed on the birth certificate. A doozy huh?

"My question is, can the grand father do anything legally to make this not happen?" Answer: No. However, you and your husband should take steps to adpot the child to remove all doubt. You should seek a consultation with a local attorney.
