Custody Issue - Step & Bio Child

My H of 4 years and I are getting a divorce. I have a 7-yr old son from another marriage, whom my husband has never officially adopted, & a 2-yr old son with my H. For $$ reasons we decided to let my husband stay home with the kids while I worked beginning 1.5 yrs ago. My H has been arrested for physical abuse to me, and recently (1 week ago) hit my oldest child in the face leaving a bruise (which I have photographed). I have removed the oldest child from his care since that time and we have since decided to get divorced. He has been very emotionally abusive to me and my oldest for years, on top of physical abuse (not as common). He's trying for custody of both kids if possible, but certainly the youngest (his bio child). I drank too much in my very distant past (10+ yrs ago) and have long since gotten that under control, although I still drank socially until recently - I no longer drink. I have never drank around the kids, and it has NEVER had an adverse effect on them. H has informed me that he intends to portray me as a drunk in court, but he's consistently exaggerated this and outright lied about it. Will this go in my favor? I have childcare taken care of the boys, btw, should I get custody.

Anyone, like your H, can claim anything. Proving it is another matter. Consult with a local attorney.

From the information that you provided, you will be wise to retain a lawyer to represent you as soon as possible. Although you have shared some facts, an attorney will need to have more information and an opportunity to discuss it with you. Keep in mind that your husband may try to obtain alimony in addition to custody.
