custody and ligitimization

My daughter just turned 5 and her dad has decided after 5 years that all of the sudden he wants to establish paternity,legitimize her, and fight for custody. He has obtained an attorney and I have been served papers. My question is is there a statue of limitation on how long a dad has till its a point of walking away and abandoning a child?
