Custody Modification

My divorce and custody took place in Alaska. We had divided primary custody. Since we both live away from Alaska now, they will not hear the modification. We still have primary custody in AZ for the one child, and are trying to gain primary custody of the other child. The mother has asked for me to take him and he now resides in AZ with me. She lived in GA for 7 months before sending him here. How can I file custody in GA for only one child and work the child support when there is another child involved? Are there exceptions that would allow me to file for both in AZ instead?

You should likely be able to assert jurisdiction here especially if she is in agreement. You will need to get certified copies of all of youf previous orders/decrees so you can file them here and have the court take notice of them as formal orders of Arizona.

Since you used the past tense "lived" referring to GA, I assume she no longer lives here. Thus, there is no action you can take in GA. As to whether AZ law or other intra-state treaties allow you to file in AZ, you will need to consult with a domestic relations lawyer in AZ.
