Legal Question in Family Law in Georgia

custody of my son

I have been married less than 4 years. My wife recently adopted my four year old son and is threatening to sue me for full custody when I divorce her. How can I get full custody of my biological son?

Re: custody of my son

Having consented to the adoption that your wife attains the status of having all the rights of the child's natural mother. You should consult with a local attorney how your local judges are likely to rule in a case like this.

Re: custody of my son

Once there is an adoption, and you were certainly told that in the adoption process, the child is as much hers and yours. While it is POSSIBLE that in a divorce you might get full custody, there is no way to guarantee that. In allowing the adoption, you allowed her to have custody as well. While some Judges might lean towards a bio-parent in such a dispute, there is no law that backs up that leaning.
