I have a 3 year old daughter out of wedlock and me and the father are splitting up and I would like to know what rights he has. He tells me if I leave her with anyone that he will get them for kidnapping if he does not agree for her to be there. I need to know that if we live apart if he can come get her at anytime of the day with he knowing.

In Georgia, the father of a child born out of wedlock has no rights to the child. The father must go to court to legitimate the child and then petition the courts for visitation of the child. To answer your questions, the father cannot come to your home to visit the child at all if you do not want him to. He has no rights to this child at this point. You have all the rights until he goes to court to legitimate the child. Feel free to contact my office for further consultation on the matter.
